Terms and conditions:

1 – Quotation
A quotation is drawn up for each assignment in which the assignment is clearly described. It is also recorded how, when and with whom the assignment is carried out. If applicable, the quotation amount will be specified and explained as much as possible. Quotations are without obligation and valid for two months, unless stated otherwise. If a customer agrees with a quotation, (s)he must confirm the assignment by replying to the email with the quotation offer. By accepting the offer, the customer also agrees to these terms and conditions. If other conditions are set in the quotation than the ones included in these general terms and conditions, then those conditions overrule the ones in these general terms and conditions.

2 – Additional work

If an assignment changes in such a way that it exceeds the work described in the quotation, then this is additional work. The costs may be charged for this. Should this situation arise, The Bold Elephant will inform the client in good time.

3 – Assembly
To ensure efficient installation in terms of time and costs, the client gets one moment to give feedback on the structural and substantive choices, as well as on the details (timing, colour editing, titles, transitions, etc). 
Based on possible feedback, The Bold Elephant will adjust the edit after which the production is finished. 

If further adjustments are required afterwards, this can be charged as additional work.
Previews will be made available on Vimeo and are password protected.

4 – Travel and accommodation expenses
The travel allowance is 0.25 euros per kilometer driven. An additional travel time allowance may be charged for journeys longer than an hour. Travel costs stated in the quotation are indicative. When invoicing, the actual travel costs incurred will be charged.

5 – Music rights

If copyright protected music is used, music rights must be paid to the Buma Stemra foundation. The Bold Elephant can provide an estimate of the costs. These costs are included in the quotation but may be higher or lower in the final invoice. This has to do with the complex rates of the BUMA/STEMRA foundation.
It is also possible buy royalty-free music. With this, all music rights are paid with a clear, one-time amount. When we use royalty-free music that is free of charge, the musician often demands that his/her name and the song title are shown in the production.

6 – Copyright

All text, sound and images produced by The Bold Elephant (concepts, scripts, scripts, video images, photos, animations, etc.) are subject to copyright and are protected by copyright. Use of copyrighted material must be authorized by the author.

7 – Intellectual Property

Workflow, templates, designs, forms, setups, camera settings and editing documents are the intellectual property of The Bold Elephant and are not made available.

8 – Copyright

A customer receives the copyright to the video production ordered by him/her, for the purpose specified in the quotation. Should a customer wish to extend the copyright or make physical copies, this will be done in consultation with The Bold Elephant. This also has to do with any rights of third parties to used music and visual material. In case of copyright infringement, the Bold Elephant is not responsible for any claims from third parties.

9 – Camera material (footage)

Unless otherwise agreed, camera material is not made available without further ado. In contrast to the delivered video production, the copyright on the camera material rests with The Bold Elephant. This copyright is negotiable. For a fee, camera material can be stored on HDD by The Bold Elephant. The Bold Elephant is not liable for loss of the material. If no agreements are made about storage, The Bold Elephant will store or destroy the material at its own discretion.

10 – Payment
The standard payment term is 14 days after receipt of the invoice. In the event of late payment, the following terms and costs apply:
First reminder: 10 days, no extra costs.
Second reminder: 10 days, 25 euros administration costs and legally required interest.
Third and final reminder: collection costs and legally required interest.

11 – Retention of title

The client does not own the video production until payment has been received. Please note: 'owner' does not mean that the copyright also belongs to the client. See “8 – copyright”. The client only becomes the owner of the product or service to be delivered described in the quotation.

12 – Liability
The Bold Elephant is liable for demonstrable damage up to a maximum of the quoted amount.

13 – Privacy statement We handle the data of our customers with care. We only keep the data that is necessary for pleasant business with each other. Data and video recordings are not resold. All data is either offline or on well-secured servers.
